Incumbent Democrat Debbie Stabenow is still outrunning her two leading Republican challengers in Michigan's U.S. Senate race.
The latest Rasmussen Reports telephone survey of Likely Michigan Voters shows Stabenow with 47% support, while businessman Clark Durant picks up 39% of the vote. Four percent (4%) like another candidate in the contest, and 10% are undecided.

I can't imagine how anyone who pays the slightest amount of attention to what is going on in Washington could vote for Debbie Stabenow. Seriously.

Also, she has gained nation notoriety when Citizens Against Government Waste named Stabenow "Porker of the Month" in March of this year.
In celebration of St. Patrick's Day earlier this month, and in recognition of the potfuls of taxpayer gold that have been squandered on subsidizing ill-advised green energy programs, Citizens Against Government Waste (CAGW) has named Sen. Debbie Stabenow (D-Mich.) Sen. Stabenow's ultimately unsuccessful amendment exemplifies the public policy fallacy gripping the Obama administration and many lawmakers, which holds that the key to unlocking a green energy surge is simply more taxpayer money.

"The past six months have been marred by examples of the futility of picking winners in energy markets...Failures at Solyndra, Ener1, Beacon, Tesla, Amonix, Evergreen Solar, SpectraWatt, SunPower, and others make it obvious that the government has about as much chance of stumbling across a four-leaf clover as it does of being successful as a venture capitalist," declared CAGW President Tom Schatz.

Researchers have for years worked to develop accurate, inexpensive and portable electronic olfactory sensing technology that can be used to detect and monitor asthma, kidney disease, high cholesterol and a number of other conditions.

A variety of approaches are being used to develop what are referred to, inevitably, as e-noses?devices that use an array of chemical sensors for reading odors and a mechanism for identifying different scents. They typically cost about $8,000 to $30,000. Most rely on bulky gas chromatography and mass spectroscopy systems to identify airborne compounds. They generally require several breaths saved in a balloon. Other breath-analyzing devices, such as alcohol Breathalyzers, use technologies that are not sufficiently accurate for medical use.

An e-nose's ability to recognize a particular odor and flag it as a warning sign has been hindered by lack of specificity?that is, the inability to detect and quantify a single substance in an exhalation that contains hundreds of compounds. Several new approaches aim to overcome that problem. One promising project involves a team of? Stony Brook University, The State University of New York, researchers led by associate professor of materials science and engineering Perena Gouma, who have developed an e-nose that uses semiconducting ceramic sensors to detect disease and measure metabolic functions.

According to Gouma, the sensor is highly sensitive to gaseous disease-signalling markers in the breath?it can detect specific molecules in parts per billion. The sensor chip is covered with spaghettilike metal oxide fibers that have diameters ranging from one to 100 nanometers (a nanometer is one billionth of a meter). The nanofibers' crystalline structure and the atomic configuration on their surfaces determine which compound can be detected. For instance, gases such as carbon monoxide and methane stick to a nanofiber oxide sensor whose atoms have a tetragonal (four-sided) arrangement. Nanofibers can be made in large quantities and tweaked during production to respond to different compounds. Once the e-nose detects its target molecule, its concentration is shown on a digital display.

Breath contains hundreds of volatile organic compounds that are by-products of our metabolism. Certain diseases alter the mix of gases, introducing new compounds or altering the levels of existing ones, Gouma says. One sensor could detect acetone in the breath of diabetics to determine whether they need to increase their insulin doses. Another could measure nitric oxide in asthmatics' breath to detect an impending or worsening asthma attack.

Gouma's group is also developing e-noses to detect the organic compound isoprene to measure cholesterol levels, ammonia to detect kidney disease, and a mix of ammonia and ketones to get a whiff of liver disease. The researchers are also developing an e-nose that can distinguish between two similar chemical structures?alkanes and alkenes?for early detection of lung cancer, Gouma says.

These prototype e-noses resemble hardcover novels with a mouthpiece attached at one end. Gouma anticipates the final design will be about the size of a key ring. She expects at least one of her e-noses will be ready for clinical testing within a year. Unlike other e-noses, Gouma's require only a single breath to detect specific compounds, she says. This means for some conditions breath tests can be performed in lieu of blood samples. Gouma anticipates such handheld e-noses such as these could cost as little as $20 each.

Nathan Lewis, a chemistry professor at the California Institute of Technology, is also developing e-nose technology. His system relies on polymer films rather than nanoscale wires to identify compounds. But he says with respect to Gouma's gizmos: "Ceramic nanosensing technology is one promising approach for medical and other electronic-nose applications. [Gouma's] work is a significant step forward in that regard."

Other researchers, however, are skeptical about an e-nose's ability to analyze individual components of even simple mixtures of volatile organic compounds (VOC). "Among the challenges to obtaining clinically useful measurements of breath VOCs, such as acetone or other possible disease markers, one of the toughest is reliably differentiating the marker or markers from the background VOCs found in breath," says Edward Zellers, an environmental health sciences professor at the University of Michigan. He adds, "This has not yet been demonstrated with any e-nose technology of which I am aware." Still, although he is wary of e-noses being used for disease diagnosis, Zellers says Gouma's technology has promise as a means of detecting individual reactive inorganic markers such as nitric oxide and ammonia.

As Hippocrates may have attested, promising medical ideas frequently do not come to pass. Patients should not hold their breath in anticipation of inexpensive handheld e-noses until the technology proves it is up to snuff in clinical trials.

Asst. NY Attorney General Killed In Brooklyn After Church Hit By Lightning

NEW YORK? ? An assistant New York State Attorney General was killed Thursday in Brooklyn after lightning struck the rooftop of a church as he was walking past.

Richard Schwartz, 61, died at the hospital. He was walking by Christ Church in Cobble Hill around 8 p.m. when witnesses said a sudden bolt of lightning hit one of the four steeples.

?There was a huge flash of lightning right above the church and I thought what I was hearing was thunder, it was that loud,? said witness Nicole Wheir, who lives next door to the church. ?It sounded like a subway coming in.?

Authorities said the lightning strike sent the spire on the church tower crashing into the sanctuary, unleashing an avalanche of large rocks that crashed onto some scaffolding which then collapsed onto Schwartz as he was walking by.

He was taken to a nearby hospital where he died.

?It?s awful. The church has been here for a long time. To have it just collapse like that,? said resident Martin Weiss.

?I feel sorry for his family,? said neighbor Joe Ignari. ?I know he?s got a young daughter, that she used to come and visit him.?

Church Rector, Rev. Ronald Lau, said the scaffolding went up about a month ago. A notice outside the church said the tower was being examined for wear and tear after a previous lightning strike and last year?s earthquake that hit the city.

?I?m rather speechless. I?m devastated. I?m extremely sad,? Lau said. ?On the other hand, I profess a religion that is full of hope and resurrection and that is my hope for what?s going to happen here.?

Lau said the Diocese was responsible for putting up the scaffolding.

?I?m not an architect, not an engineer,? Lau said. ?I?m a priest.?

Schwartz served in the Attorney General?s Office for 25 years and was just blocks from his home when the storm hit.

In a statement Friday, Attorney General Eric Schneiderman said Schwartz was an expert in anti-trust cases and ?served the people of New York State with integrity.?

?New York is a better place because of Richard?s commitment to fairness and legal excellence,? said Schneiderman. ?Richard?s loved ones are in our thoughts and prayers as we mourn the untimely loss of one of our own.?

German support for Merkel's crisis handling erodes: poll

BERLIN (Reuters) - Only one third of Germans still believe Angela Merkel is making the right decisions over the euro zone debt crisis, according to a survey published on Sunday, pointing to a steep erosion in domestic support for the chancellor over the last weeks.

The survey by YouGov, due to be printed in Monday's edition of Bild newspaper, found 33 percent in favor of her stance but 48 percent against, a setback for the chancellor who is to seek a third term in a 2013 federal election, which she has vowed to make a vote on Europe.

Asked in the survey whether they feared for their savings, 44 percent of Germans said that they did.

In mid-July, a poll by ZDF-Politbarometer showed 63 percent of Germans backed Merkel's handling of the crisis, although a majority thought she should explain her policies better.

Another poll at the start of July by Infratest-ARD put support for Merkel's crisis policies at 58 percent, although 85 percent of those polled also expected the crisis to get worse.

Merkel's tough stance on the crisis and demands for austerity in exchange for aid have seen her demonized across Europe, but earnt her popularity at home.

The euro zone entered a threatening new phase in the last weeks, however, as concern rose Greece would be unable to meet its bailout conditions and Spanish and Italian assets came under renewed market attack, stirring fears about the rising cost of Europe's debt crisis for German tax payers.

Last week Moody's Investors Service changed its outlook for Germany, the Netherlands and Luxembourg to negative from stable as Germany might have to increase its support for troubled states.

The Arizona decision gave strong support for city and state laws that rely upon communications between the federal and state or local officials regarding immigration status inquiries.? First, the Supreme Court noted clear encouragement by Congress for state involvement in sharing immigration status and enforcement data:? ?Consultation between federal and state officials is an important feature of the immigration system.? Congress has made clear that no formal agreement or special training needs to be in place for state officers to ?communicate with the [Federal Government] regarding the immigration status of any individual. . . .?? Arizona v. United States, 183 L. Ed. 2d 351, 376 (2012)

Second, Arizona explained that Congress requires the Federal Government to answer requests for immigration status inquiries made by state and local officers:? ?Congress has obligated ICE to respond to any request made by state officials for verification of a person?s citizenship or immigration status.?? Id. at 376-77 (citing 8 U.S.C. ?? 1373(c); 1226(d)(1)(A)).?

Finally, the Supreme Court explained that ICE must respond even if local police interests and DHS agency priorities differ:? ?[T]he [Arizona] officers must make an in inquiry even in cases where it seems unlikely that the Attorney General would have the alien removed. . . .Congress has done nothing to suggest it is inappropriate to communicate in these situations.? Indeed, it has encouraged sharing of information about possible immigration violations.?? Id. at 377 (citing 8 U.S.C. ? 1357(g)(10)(A)).

The IRLI brief explains that the Hazleton ordinance was built on this doctrine of extensive cooperation and the required federal government response to local immigration status inquiries.? Hazleton requires all individuals to submit information when obtaining an occupancy license in the City.? After receiving a valid complaint, the City uses that information to verify the immigration status of that individual with the federal government?to which the Federal Government must respond.?

Oral arguments are scheduled for mid-August in Philadelphia.

The Writing Quest

My love for story books began during school years. Being in a boarding school with a strict study regime, reading a novel was similar to committing a forbidden sin. And that excited me! Having a copy of Mills & Boon hidden on my laps during preparatory time was a sweetest dessert treat after the unpalatable dinner of corn and beans. The Headmistress would silently peek on the windows to see who committed a crime of talking, falling asleep or reading anything unrelated to school work. I was always caught, punished but happily repeated my crime of reading the forbidden stories.

A breakthrough came when my English language teacher urged me to join a regional essay competition, since I loved books so much. I did and won a bible. A second opportunity of writing came. With my teacher?s guidance I wrote my first ever drama play. It was performed when other schools visited us.

I stopped writing.

Sixteen years later I began writing again. But this time it wasn?t for enjoyment. It was a craving for taking out the destructive emotions eating my mouth to silence. A series of events and feelings led me one day to simply sit down, switch on the computer and write. I had studies to do as I was pursuing my Master?s degree but that did not matter. I wrote until all my emotions found a new home on the computer screen. To date, it is the longest poetic prose I have ever written. Days later I discovered blogging and began to share my poems. A friend suggested I compile them into a book. I listened to that precious advice but did not act on it immediately. Instead, I chose to tread carefully with a written short story to an on-line magazine. Based in a German speaking country where I write in English, I decided to randomly choose an English publisher and found one in Poland. I sent my story (the poetic prose converted to a short story) and it was picked, ?Editor?s Choice of the Week.??

I was writing again.

My hunger for writing grew and with it came an appetite to share. But how would I do that? I read about publishing and it seemed like a bureaucratic process involving sending manuscripts to as many as you can and probably all could end up in the bin. If one was lucky to be published, they needed an agent. Then I read of self-publishing and my instincts felt it was the right way to go despite the negativism I read of vanity publishing. I resorted to the help of search engines and AuthorHouse came on the top of the list. I wrote them an email and Mr Daniel Cooke responded. What a joyful experience it was. I instantly felt bewitched by self-publishing as it gave me the fulfilling sense of ownership throughout the process. Additionally as nature lover, I am a fan of the Print-On-Demand technology, whereby books are printed only when an order has been placed. May the trees live longer until each author has penned their thoughts from imagination wilderness!

Small Island Fund, Big Bankruptcy Wave ? U.S. Public Pension ...

On June 13, 2012, U.S. Bankruptcy Judge Robert J. Faris from the United States District Court for the Northern Mariana Islands concluded that the Northern Mariana Islands Retirement Fund?a public pension fund established for the commonwealth territory?is a ?governmental unit? and, pursuant to the Bankruptcy Code, cannot be a chapter 11 debtor.

According to the declaration of the fund?s administrator, the fund was experiencing severe financial problems in the years leading up to its bankruptcy filing.? The fund administrator asserted, among other things, that ?chronic underfunding? of the fund by the commonwealth and certain of its agencies necessitated the filing.? Adding to these problems was the fund?s inability to benefit from recent financial market opportunities because the fund is restricted from investing in anything other than ?extremely stable, low yield investments.?

On April 17, 2012, the fund filed a petition for relief under chapter 11 of the Bankruptcy Code, claiming that its assets would be entirely depleted within two years absent restructuring of its benefit obligations.? The fund administrator declared that a benefits reduction from 100% to 42% was necessary to sustain the fund as a going concern.? Such a reduction would, according to the administrator, enable the fund to continue to increase its assets and, thereafter, increase or restore benefit payments.

Soon after the fund filed its petition, the government of the Commonwealth of the Northern Mariana Islands, the United States Trustee for the District of the Commonwealth of the Northern Mariana Islands, and certain other parties in interest filed motions to dismiss the fund?s bankruptcy case.? In their respective motions to dismiss, the commonwealth government and the U.S. Trustee contended, among other things, that the fund?as an instrumentality of the commonwealth government?was a governmental unit and, therefore, ineligible to be a chapter 11 debtor.

In its omnibus response to the motions to dismiss, the fund countered that it is not a governmental unit within the meaning of the Bankruptcy Code because (1) the fund?s activities?the collection and investment of contributions?are not traditional government functions, and (2) the commonwealth government lacks ?active control? over the fund. ?The fund also claimed that public policy considerations warranted a finding that the fund was eligible to be a chapter 11 debtor.? The fund specifically noted that chapter 9 was not an available option because the fund ?operates within a territory of the United States rather than a ?State? as that term is used in Bankruptcy Code Section 101(52)? and stated that, if the fund is deemed ineligible to be a chapter 11 debtor, it would ??fall[ ] between the cracks? of the Bankruptcy Code.?

In his memorandum of decision, Judge Faris concluded that the fund is a governmental unit, as defined by the Bankruptcy Code, and therefore is not eligible for chapter?11 relief.? In reaching this conclusion, the court began with a fundamental observation that, pursuant to section 109 of the Bankruptcy Code, ?[o]nly a ?person? may be a debtor in a chapter?11 case.?? Section?101(41) of the Bankruptcy Code expressly provides that a ?governmental unit? is not a person.? Pursuant to section?101(27) of the Bankruptcy Code, ?the term ?governmental unit? means United States; State; Commonwealth; District; Territory; municipality; foreign state; department, agency, or instrumentality of the United States . . . a State, a Commonwealth, a District, a Territory, a municipality, or a foreign state; or other foreign or domestic government.?

The court focused on whether the fund was an instrumentality of the commonwealth government.? Because the Bankruptcy Code does not define the term ?instrumentality,? the court attempted to derive the ?plain meaning? of ?instrumentality,? but concluded that the term lacks a unique or single plain meaning.? The legislative history of section?101(27), however, provides guidance as to the term?s meaning, and explains that the relationship between a government and an entity ?must be an active one in which the . . . instrumentality is actually carrying out some governmental function.?

Applying this standard, the court concluded that the fund is an instrumentality of the commonwealth government because the fund performs certain functions of the government.? Specifically, the court observed that the government of the commonwealth formed the fund to carry out the government?s benefit obligations to its current and retired employees.? The court opined that ?[p]roviding compensation and benefits to government employees is a quintessential government function.?

The court rejected the fund?s argument that managing and investing contributions was not a ?traditional government function? because, unlike private financial institutions, the fund administered the plan for the sole benefit of the government?s employees.? The court also rejected the fund?s argument that the commonwealth government lacked the control necessary for a finding that the fund is an instrumentality thereof.? According to the court, the commonwealth maintained substantial ongoing influence over the fund.? The court further explained that the fund?s sole function was to effectuate the obligations of the government.? Put simply, the fund ?does literally nothing other than carry out the government?s duties.?

Although the court ruled that chapter 11 was not an option for the fund, the court highlighted the fund?s financial dilemma and commended the fund?s trustees? efforts to compensate retirees despite the unwillingness of the commonwealth government to pay its contribution debts.? Nevertheless, the court opined that ?Congress did not intend that the Bankruptcy Code could solve all problems, least of all the financial problems of governmental units.?

Despite the court?s eligibility ruling, other U.S. public pension funds may have better luck obtaining chapter 11 relief.? Because the Northern Mariana Islands Retirement Fund ruling chiefly turned on the fund?s lack of autonomy and its limited function, public pension funds with greater independence may be able to avoid categorization as instrumentalities, and, consequently, satisfy the eligibility requirements for chapter?11 debtors.? On the other hand, a bankruptcy filing and adverse eligibility ruling could deplete an insolvent fund?s already-limited assets.? In light of a recent announcement by Moody?s that adjusted fiscal 2010 state and local unfunded pension liabilities exceed $2 trillion?an amount ?three times the total reported by governments??some public pension funds? best bet may be to take their chances in the bankruptcy courts.

Deny This: Contested Himalayan Glaciers Really Are Melting, and Doing So at a Rapid Pace-Kind of Like Climate Change

tibetan-plateauRemember when climate change contrarians professed outrage over a few errors in the UN Intergovernmental Panel on Climate Change?s last report? One of their favorite such mistakes involved an overestimation of the pace at which glaciers would melt at the ?Third Pole,? where the Indian subcontinent crashes into Asia. Some contrarians back in 2010 proceeded to deny that the glaciers of the Himalayas and associated mountain ranges were melting at all. But now, using satellites and on-the-ground surveys, scientists note that 82 glaciers in the Tibetan Plateau are retreating, 15 glaciers have dwindled in mass, and 7,090 glaciers have shrunk in size.

Why? The culprits include rising average temperatures characteristic of ongoing global warming and changes in precipitation, another sign of climate change, according to Lonnie Thompson of Ohio State University and his colleagues from the Chinese Academy of Sciences. The study appeared online in the journal Nature Climate Change on July 15?and is bad news for the hundreds of millions of people who rely on such glaciers to feed water into major rivers such as the Ganges, Mekong or Yangtze.

But climate contrarians have moved on, of course. This June, atmospheric scientist Richard Lindzen of the Massachusetts Institute of Technology, one of the only remaining climate contrarians actually trained in climate science, dismissed the documented 0.8 degree Celsius rise in average temperatures in the past 150 years or so as a small change during a talk at Sandia National Laboratory. Yet, that small change has resulted in events like chunks of ice double the size of Manhattan breaking free of the ancient Greenland ice sheet last week. Just a few years ago, an even bigger ice-massif crashed into the sea. Events that once happened every few decades in Greenland now happen every year or so.

That ?small change? has also been enough for weird weather to play havoc around the world, whether it be the epic drought currently over-baking Midwestern corn crops or the torrents of rain unleashed this year on Beijing, killing at least 77 people, according to the Xinhua news agency. The list of weather-related disasters continues to get longer with each passing year and, while no single weather event can be tied directly to climate change, our continuing fossil-fuel burning loads the climate dice in favor of more and more snake-eye rolls such as deadly floods or searing droughts. It?s all unfolding pretty much as predicted by climate scientists in the 1980s.

What?s also unfolding pretty much as demanded by climate contrarians is a dearth of efforts to address the problem, maybe because we?re all in denial. Global emissions of the greenhouse gases responsible for all this continue to grow, after taking a brief dip due to the Great Recession. Political and policy efforts to address the climate crisis, whether at the national or international level, seem spent (although there is some hope in efforts to buy time to combat climate change by cutting back on soot). Witness the climate talks in Durban, Cancun or Copenhagen. In the U.S. about the only leader still advocating for action to halt climate change is Bill McKibben, who has become somewhat of a climate Quixote, tilting for windmills and against the fossil fuel industry.

That industry, particularly titans such as ExxonMobil, has expressly achieved the goals laid out in an American Petroleum Institute memo from the 1990s recently reproduced in Steve Coll?s book Private Empire:

- Average citizen ?understands? (recognizes) uncertainties in climate science
? Recognition of uncertainties becomes part of the ?conventional wisdom?
? Media ?understands? (recognizes) uncertainties in climate science
? Media coverage reflects balance on climate science and recognition of the validity of viewpoints challenging current ?conventional wisdom?
? Those promoting the Kyoto treaty [a global effort to reduce greenhouse gas emissions] on the basis of extant science appear to be out of touch with reality.

All five of those items on the list can be checked off. That?s a big part of the reason why climate change has not featured as an issue in this year?s U.S. presidential election.

What hope there is at present for addressing climate change in the U.S. lies in natural gas, dismissed as a nuisance for decades by the oil and coal industries.? The ?last fossil fuel,? primarily the molecule known as methane, is itself a potent greenhouse gas. However, burning natural gas to generate electricity produces roughly half as much carbon dioxide?the most ubiquitous greenhouse gas?as burning coal does. Already, this year, burning natural gas accounts for as much electricity as burning coal for the first time in U.S. history, and its use has helped drop U.S. emissions by 430 million metric tons over the past five years, according to the International Energy Agency.

If fracking for shale gas can work for China too, global emissions could begin to drop (though it appears more likely at present that the U.S. will export highly polluting coal to China in greater quantities than any shale gas know-how). And if there?s enough natural gas?and there certainly is if we can learn to tap the methane molecules ensconced in icy cages throughout the world?s oceans?we might even use it to displace oil as the primary fuel for our cars and trucks.

At the same time, renewables, such as solar and wind, continue to grow by leaps and bounds, and nuclear power, though it may be moribund in the U.S., is gathering a renewed head of steam in countries such as China.

None of this will happen fast enough to reduce greenhouse gas emissions at a sufficiently dramatic pace to stop climate change. After all, burning natural gas still means more CO2 molecules in the atmosphere trapping heat. Cheap natural gas will also likely slow the race to develop and deploy alternative energy as well as the sprint (in geologic terms) to a global warming of more than 2 degrees Celsius. We?re on track to achieve that over the next 40 years or so, with natural gas or without it.

That means that the people of 2100, or even 2500, will have us to blame if they don?t like the weather. In the shorter term, we?ll all have to learn to adapt to more sea level rise, weird weather, acidified oceans and other climate change impacts. The Earth is different now and will change even more?fewer and fewer glaciers at the Third Pole, less ice at the North Pole and, who knows, a few hardy plants taking root in Antarctica for the first time in millennia. There?s just no denying it.

Turn on the television or read the?news, and all you hear are the negatives about?relationships. This celebrity is leaving that one; this person cheated with that person. So, how are these couples staying happy through all the normal peaks and valleys of?marriage, coupled with today?s economic challenges? Are they just lucky? Is their mantra the proverbial ?yes, dear? with an eye roll? Well, sfter surveying 500 men and women on my?Facebook page, the answers and secrets are crystal clear.

1. Don?t communicate.?Every therapist, counselor and relationship self-help book says the same thing, ?you have to communicate.? Merriam Webster defines ?communication? as ?the successful conveying or sharing of ideas and feelings.? Sorry, but this definition of communication is largely misunderstood because, to many people, it means talking to your spouse so that he/she knows you are right.

In successful, happy relationships, people listen and empathize. They don?t necessarily agree, but they do make the effort to really hear the information, and then see it from their significant other?s point of view.

2. Go to bed angry sometimes.?The golden rule is to never go to bed angry. But, sometimes things cannot be worked out without a brief break. You both might need time to consider things, evaluate, and think. So long as the discussion hasn?t caused someone to scream and storm out the door, going to bed without completely working out a situation might allow for perspective overnight and a more connected, intelligent conversation in the morning.

3. Watch what you say.?In today?s social media driven world, words and statements fly without a care. Couples driven to stay happy and connected are careful with what they say, not only to each other, but also about each other. Often, relationships can be defined by what you say about your partner to others when they are not in the room.

4. Forget date nights. It?s all about hotel?sex.?Date nights are a great attempt to rekindle?romance. But, after working all week, diapers and homework assistance, it might not be feasible to downshift over a of couple of hours at dinner.

A better solution is hotel sex. No more, ?Shhhhh! The kids!? ?Are they asleep yet?? Or the inevitable knock at the door. Want happiness? Get a trusted overnight sitter and head out for an adult night. Get a meal and then head back to the hotel for dessert.

Low on funds due to the economic climate? Nothing wrong with a motel among consenting adults. Use your imagination and unplug from?parenting?for a bit.

LG Electronics' profit falls as mobile loses money

SEOUL, South Korea (AP) ? LG Electronics reported a lower quarterly profit as its mobile phone division sank to a loss and forecast its earnings to deteriorate further, underlining the challenges for its smartphone business as it struggles with competition from Apple and Samsung.

The South Korean company said Wednesday its April-June net income totaled 159 billion won ($138 million) on revenue of 12.9 trillion won.

Quarterly income was up nearly 50 percent from a year earlier but fell 35 percent from the previous three months.

The quarter-on-quarter drop was a source of concern for investors as sales of consumer electronics are usually stronger in the second quarter. Shares of LG Electronics Inc. fell 2.1 percent in Seoul, compared with the benchmark Kospi's 1.4 percent decline.

LG, which was unseated by Apple Inc. in 2011 as the world's No. 3 mobile phone maker by sales, blamed its lower profit on the mobile division's 57 billion won quarterly operating loss. That partly offset profit from LG's TV business.

Basic handset sales declined while expenses to promote its new smartphones went up, LG said.

The mobile business of LG Electronics is being squeezed in both the premium and low-end markets. Chinese handset makers ZTE and Huawei are aggressively increasing low-cost smartphone sales while Apple and Samsung Electronics Co. leave little room for a third player in the top-end market.

The second-quarter mobile loss comes after the division briefly enjoyed two consecutive quarters of profit. LG's mobile division lost nearly 1 trillion won in 2010 and 2011 combined as its Optimus smartphone series failed to compete with Samsung's Galaxy phone and Apple's iPhone.

LG said its third-quarter operating profit will moderately decrease from the second quarter, even as sales go up by a small margin.

"Seasonal demand for home appliances and air conditioners goes down in the third quarter, while sales of TVs and smartphones are expected to rise," David Jung, LG's chief financial officer, told investors.

Jung said profitability at the mobile communication business will not be too bad for the rest of the year with new high-end mobile device launches due in North America and Japan.

But he stopped short of guiding investors on when the company can fully turn around its mobile business, which contributed about half of the company's profit during its heyday.

Even as LG plans to expand its mobile market share with its Android-powered smartphones running on a fourth-generation wireless service, analysts are skeptical about its outlook.

Sales could falter if mobile chip shortages continue and the launch of the new iPhone, expected in the third quarter, could steal the spotlight from LG's new handset release.

"It is tough to be sure about the recovery in LG's mobile phone business," said Eugene Kim, an analyst at Taurus Securities who has a hold rating on shares of LG Electronics.

Quarterly operating profit from LG's TV business more than doubled from the previous year to 216 billion won. But the amount changed little from the previous quarter.

LG is betting on the release of a high-end television that uses an advanced display panel to boost TV profit. The company said TV markets in advanced countries will expand in the second half of this year despite a weak outlook for the global economy.

Report: Colorado shooting suspect sent plans notebook to psychiatrist

AURORA, Colo. (Reuters) - The man accused of Friday's movie theater massacre in Colorado mailed a notebook "full of details about how he was going to kill people" to a University of Colorado psychiatrist before the attack, FoxNews.com reported on Wednesday.

The package allegedly from the suspected shooter, 24-year-old James Eagan Holmes, remained unopened in a mailroom for as long as a week before its discovery Monday, FoxNews.com reported, citing a law enforcement source.

Reuters could not immediately verify the report but was seeking to do so. Messages left with police in Aurora and other law enforcement officials involved in the case were not immediately returned.

The FoxNews.com report said Police and FBI agents were called to the University of Colorado Anschutz medical campus in Aurora on Monday morning after the psychiatrist, who is also a professor at the school, reported receiving a package believed to be from the suspect.

Although that package turned out to be from someone else and harmless, a search of the Campus Services' mailroom turned up another package sent to the psychiatrist with Holmes' name in the return address, the source told FoxNews.com.

After obtaining a search warrant, police took the package away and discovered its contents.

FoxNews.com quoted its source saying: "Inside the package was a notebook full of details about how he was going to kill people. There were drawings of what he was going to do in it - drawings and illustrations of the massacre."

Police say Holmes, wearing body armor, a gas mask and toting three firearms, opened fire on a crowded midnight screening of "The Dark Knight Rises" in the Denver suburb of Aurora, killing 12 people and wounding 58 others.

Holmes, who was arrested immediately after the attack outside the theater, made his first appearance in court on Monday. Authorities plan to formally charge him on July 30. (Reporting by Dan Burns; Editing by Vicki Allen)

Giving Academia the Business | Envisioning Online Learning

An interesting commentary from William W. Keep in the Chronicle is entitled ?The Worrisome Ascendance of Business in Higher Education? (June 21, 2012).? The article starts out illustrating the conflict between administrators with business experience and faculty?s worldview. In this instance, the University of Virginia trustees with experience in ?real estate, construction, and investing, apparently saw an opportunity to transfer their knowledge to higher education.?

In essence, this Board of Trustees dismissed President Teresa Sullivan (see article) an act that was unceremoniously reversed a few weeks later amid an uproar of support for her. Keep goes on to say that ?Though colleges can learn many things from the ways businesses operate, treating college strictly like a business would be a mistake.? I would agree and have some views to share on this topic.

A Telling Tale

Over two decades ago, I was a member of a thriving food coop in Westchester County, called The Way of Life Coop. Like-minded, idealistic and health-conscious persons pooled their talents, time and monies to build and run this organization, which operated productively for many years. The coop hired a very competent manager and was guided by a dedicated Board of Directors. ?I volunteered in various capacities, ending up as editor of their monthly newsletter, for which I earned work credit.

It happened gradually, but all of it was to come to a disappointing end when an enterprising businessman decided to build a string of for-profit health food stores in the northern suburbs. The efficiency and convenience of his stores made our coop offerings less competitive and many of our potential customers decided to shop there.? The inevitable end, delayed by denial and stopgap solutions, saw the food coop lose money for the last years of its existence, eventually succumbing to the new reality.

Higher education will not be so easy a victim as our food coop.? Up to this point, it holds a virtual monopoly on the credentialing process in the form of degrees, which employers value and students see as a ticket to a promising future. This model, as many have pointed out, is currently being challenged by alternative methods of obtaining credentials (a future blog post), by higher education?s high price tag, by the failure to educate many students (see Academically Adrift study), and by the failure to secure post-graduation employment for many students. In my view, taking a cue from business may stem the bleeding, but will not alter the outcome.? Like other industries that have been drastically changed by the forces of globalization, privatization and technology, colleges will have their day of reckoning.

Higher Education: A Model Of Inefficiency?

Books have been written about why higher education needs a dramatic re-envisioning and re-structuring.? I will only highlight a few points below.

Real Strategic Planning

Businesses that hope to survive and thrive embrace strategic planning as an integral part of their operations. Most of the Fortune 1000 companies use tools like the Balanced Scorecard (Kaplan and Norton) to envision, plan, communicate, implement and measure the success of their companies. For the most part, higher education has not seen the need for a real strategic planning process other than the pro-forma 3-year plans that routinely pass for strategic planning. For the most part, these efforts are not strategic in any manner, shape or form, and are rarely actionable. Without such a roadmap, universities become slow and reactive to outside changes in their environment.

?Accountability

With all respect to civil servants who do an excellent job (like both my parents), we need to acknowledge that often such employees are neither civil, nor do they serve. Lifelong employment often means lack of accountability in terms of service, demeanor, attendance, and job performance. Colleges often have their offices staffed by unionized workers with such protection from real-world performance measures. For example, I had the frustrating situation of trying to get my office cleaned. Over the span of several years, we?ve had a constant array of custodial staff from truly awful to minimally competent. Their job performance was lacking despite frequent contact with their managers. On several occasions, the custodial manager needed to trail his employees to ensure they picked up the garbage. Off the record he told me that he was in trouble with their union for insisting they do their jobs.

Alas, the same may be said even of tenured professors who fail to perform. (Tenure is a topic for another post)? Collective bargaining has its place, but has the pendulum swung too far in protecting the non-performers? I believe it has, but that in no way implies that we must do away with unions. In addition, I feel there is an inverse correlation between innovation and unionization, with innovation being resisted most forcefully in unionized settings. Such changes are seen as diminishing faculty prerogatives and/or faculty governance agreements long fought for over years of collective bargaining. However, the trend for accountability, particularly among public institutions, is growing and is currently impacting higher education.

Adaptability

Given the balkanized nature of many higher education institutions, change comes slowly, and, grudgingly, if at all. Given the range of constituencies that need to be consulted, informed, empowered etc., it is amazing anything gets done at all. So initiatives like changing the mode of instruction, or length of the semester, or ability to transfer credits between institutions within the same university, may become occasions for pitched battles between administrators, faculty and other constituencies.? As a result, change is delayed, denied, or diminished.

With time, educational institutions will use many methods to enhance the delivery of their core mission. Increasing efficiency, however necessary, will be insufficient for colleges seeking to respond to the many environmental challenges ahead. Alternate credentialing, massive open online courses (MOOC), open educational resources, and other trends will ultimately impact negatively on institutions that fail to evolve. I believe these changes are on the level of ?paradigm shifts? that require a fundamental re-thinking regarding the nature of teaching, learning and the university.? Will CUNY and other universities be up to the challenge?
